This Invitation for Tenders follows the General Procurement Notice for this project, the updated version of which was published on the EBRD website on 3 August 2011, and in the UN Development Business.

The State Enterprise "Donets'ka Zaliznytsia" hereinafter referred to as the Purchaser, intends using the proceeds of a loan from the European Bank for Reconstruction and Development (the Bank) towards the cost of the Ukrainian Railways: Rolling Stock Renewal Project. The purpose of the Project is to procure new general purpose freight wagons.

The Purchaser now invites sealed tenders from eligible suppliers for the following contract to be funded from part of the proceeds of the loan:

Lot 2: 200 Nos. General Purpose Freight Gondola Wagon

Tendering for contracts to be financed with the proceeds of a loan from the Bank is open to firms from any country. The proceeds of the Bank's loan will not be used for the purpose of any payment to persons or entities, or for any import of goods, if such payment or import is prohibited by a decision of the United Nations Security Council taken under Chapter VII of the Charter of the United Nations or the law of Purchaser's country.

To be qualified for the award of a contract, tenderers must satisfy the following minimum criteria:

• The tenderer has satisfactorily supplied similar goods to other purchasers including wagons capable of 120km/h speed fully loaded or empty.

• The tenderer shall provide names, addresses and contact details of all Purchasers of similar goods over the last 2 years.

• Tenderers shall demonstrate that they have supplied at least 200 of similar freight gondola wagons bid over the last 2 years.

• The manufacturer will be accredited to the appropriate parts of the ISO 9001:2001 quality assurance standard, or substantial equivalent. The tenderer shall provide all appropriate certificates. The Purchaser will reserve the right to verify the tenderer's quality control within the evaluation period of proposals and up to the final acceptance of the equipment.

Tender documents may be obtained from the office at the address below upon payment of a non-refundable fee of US$200 (Two Hundred United States Dollars) or UAH (Ukrainian Hryvnia) equivalent. Currency exchange rates shall be in accordance with rates set by National Bank of Ukraine on the date of payment.

Payment shall be made by bank transfer and documents shall be released upon provision by the Tenderer of a receipt showing funds were transmitted to the following accounts, or upon confirmation from Purchaser's bank that funds have been received. Cash payments are not permitted.

If requested the documents will be promptly dispatched by courier and, in addition, electronically via e-mail but no liability can be accepted for loss or late delivery. Tenderers should note that electronic version of the tender documents will be issued solely to facilitate tender preparation. In the event of any discrepancy between hard and electronic copies of the tender documents, the hard copy will prevail.

All tenders must be accompanied by a Tender Security of:

or its equivalent in a currency of tender or in any freely convertible currency.

The tenders shall be delivered to the Purchaser's address below on or before 10:00 a.m. (Kiev time) on 20 September 2011, at which time they will be opened in the presence of the tenderers' representatives who wish to attend.
